Upon the expiration of the two year time period, a gift certificate, a store gift card, or a general use prepaid card may be subject to expiration if the following disclosures are printed clearly in a conspicuous place on the front or back of the gift certificate, the store gift card, or the general use prepaid card in at least point type: The date on which the gift certificate, the store gift card, or the general use prepaid card expires.. The Bank shall make no objection to the mediator except for good cause shown. All disputes arising from or related to your Card or this Agreement shall be governed by the substantive laws of the State of Texas without regard to its conflict of laws principles. You are solely responsible for selecting and approving Authorized Cardholders, and each Authorized Cardholder is in turn responsible for the security of their own PIN. Where there is any conflict of law regarding an appeal of any decision of the arbitrators, you and the Bank agree that Texas law shall control. By retaining and using the Card, permitting another to use the Card, signing the Card or any sales draft in connection with use of the Card, or continuing to use Frost Online Banking Services or Hour Phone Services after the date you get the Card or the effective date of any amendment, it will be the same as if you and your users: i signed this Agreement and subsequent amendments thereto; and ii consented to the terms of this Agreement and any subsequent amendments. It is the intent of the Legislature that this section apply to the custodial holding of unredeemed gift certificates and credit memos. The arbitrator can award damages or other relief provided for by law to you or Frost, but not to anyone else. No award or relief will be granted by the arbitrator except on behalf of, or against, a named party. Notwithstanding the time limitation in subsection 1, a gift certificate redeemable for merchandise only that is not subject to an expiration date and that is not subject to a deduction from the face value of the gift certificate for failure of the owner of the gift certificate to present the gift certificate in a timely manner, or subject to any other charge or service fee, which card remains unpresented, shall continue in force and be eligible for presentation for an indefinite period of time, and shall not be subject to a presumption of abandonment. Currently, an amount may not be deducted unless a valid and enforceable written contract exists between the issuer and the owner of the gift certificate pursuant to which the issuer regularly imposes charges for failure to present and does not regularly reverse or otherwise cancel them. If you and Bank are unable to resolve the dispute through negotiation, then you and Bank agree to submit the dispute to mediation. You also agree that by using such Services to make any Transactions or requests requiring your signature, we will consider you to have signed, and are therefore also be bound by, any applicable deposit or withdrawal order, or any similar document or instrument by the use of your PIN. Under the bill, the prohibitions numbered 2 and 3 above do not apply to a gift obligation given or sold for less than face value to a nonprofit organization, a person who transfers the gift obligation to another person primarily for the benefit of a nonprofit organization, or to a gift obligation issued for no consideration.
